Marketplace Terms

These Marketplace Terms govern access to and use of the SparrowHawk CRM Marketplace by buyers. They supplement the Terms of Service and the Privacy Policy. Vendors are governed by the Vendor / Seller Agreement.

Except for products or services identified as sold directly by SparrowHawk CRM LLC, the Marketplace is a venue that connects buyers with third-party vendors. Vendors are independent third parties and are the sellers of their listings. SparrowHawk CRM LLC is not a party to the sales contract between a buyer and a vendor and does not warrant vendor listings, vendor conduct, or the suitability of listed items for any particular purpose.

Where a listing is explicitly sold by SparrowHawk CRM LLC, SparrowHawk CRM LLC is the seller and stands behind the sale on the terms of the listing.

Vendors are responsible for the accuracy of their listings, product descriptions, images, specifications, compatibility claims, certifications, safety data sheets, and regulatory disclosures. Buyers should independently verify that a listed item is suitable and lawful for the buyer's intended use, including for any aircraft, vehicle, facility, or jurisdiction involved.

Orders are placed at the price and quantity shown at checkout. Payments are processed by Stripe under Stripe's terms. SparrowHawk CRM LLC does not store full card numbers or card security codes. Orders may be canceled by SparrowHawk CRM LLC or the vendor before shipment if the listing was in error, out of stock, priced incorrectly, or if the order fails fraud checks.

Prices exclude applicable taxes and shipping unless clearly stated. Buyers are responsible for all sales, use, VAT, GST, customs, duties, brokerage, and similar taxes and fees applicable to the transaction. Vendors are responsible for collecting and remitting the taxes for which they are the merchant of record.

Fulfillment is performed by the vendor unless otherwise stated. Delivery times, carriers, and tracking are provided as estimates. Risk of loss passes according to the shipping method selected and the vendor's stated terms.

Return, refund, and warranty terms are set by the vendor and disclosed on the listing. Buyers should read those terms carefully before ordering. Where SparrowHawk CRM LLC is the seller, the return policy stated on the listing applies.

Disputes about an order, delivery, quality, warranty, or refund should first be raised directly with the vendor through the Marketplace's messaging tools. SparrowHawk CRM LLC may, at its discretion, provide platform-level mediation, reverse funds held in escrow where applicable, or take account-level action against a vendor for repeated verified disputes, but SparrowHawk CRM LLC is not a party to the underlying sale and is not obligated to reimburse buyers for vendor conduct.

Certain items may be restricted by law, by SparrowHawk CRM LLC policy, or by carrier rules — including unapproved aircraft parts, controlled aviation-technical data, weapons, hazardous chemicals not accompanied by proper documentation, counterfeit goods, and items subject to export or sanctions controls. Buyers may not purchase or arrange for shipment of restricted items in violation of applicable rules.

Buyers must comply with the Acceptable Use Policy, may not use the Marketplace to defraud vendors, submit chargebacks in bad faith, or scrape listings, and must maintain accurate account and shipping information.

SparrowHawk CRM LLC may suspend or terminate Marketplace access for violations of these terms, the Acceptable Use Policy, or the Terms of Service. Order history may be retained for legal, tax, and dispute-resolution purposes as described in the Data Retention & Deletion Policy.
